Examples of Our Success

Landfill Liability Defense - Successfully defended international iron foundry/pump manufacturer (waste generator) in private landfill action, including nearby landowners claims, alleging liability under CERCLA, HSRA, nuisance, negligence, and trespass for contamination of their property and drinking water. In addition, represented the manufacturer in one of Georgia's first HSRA multiparty landfill actions, obtaining favorable settlement and insurance coverage.

Environmental Remediation - Represented operators of underground storage tank sites in Georgia, Florida, Kentucky, Missouri, North Carolina, and South Carolina in state remediation proceedings and obtained trust fund reimbursement.

Superfund Action - Represented potentially responsible parties in Superfund actions including: Aqua-Tech Site, Greer, South Carolina, Enterprise Recovery System's Site, Byhalia, Mississippi, Rouse Steel Drum Site, Jacksonville, Florida, Pickettville Road Landfill Site, Jacksonville, Florida, and Florida Petroleum Reprocessors Site, Davie, Florida, Alternate Energy Site, Augusta, Georgia.

Environmental Property Damage Claim - Successfully defended a coastal Georgia county in an environmental property damage claim; represented the county in a HSRA multiparty landfill action, obtaining state reimbursement for expenses.

Insurance Coverage Claims - Successfully litigated denied insurance claims, obtaining insurance coverage as well as corrective action expenses and attorney fees.
